Terms & Conditions

KAP-Design  will follow the Client’s requests closely to create the desired end result for the custom project.  Client agrees to give KAP-Design the freedom of creative changes of the decided design for the sake of stability, structural integrity, or other certain emergencies. Client also understands that although KAP-Design will do its best to match specific colors, that color matching is not easily perfected. KAP-Design would be happy to design something for you or work off your ideas including inspiration photos. Client also understands that cake design is a creative art form, and therefore final design is an interpretation of the agreed upon design. KAP-Design cannot duplicate an exact copy of another artist’s work but will ensure the look is similar. 

• All details are handmade and edible (unless otherwise noted) with the exception of any required supports. 
• KAP-Design will not be responsible for consumption of or injuries caused by any non-edible items placed on your cake/treat, such as dowels, flowers, wires, pearls, ribbons, etc. Any non-edible items must be removed by the client before the cake or treat is consumed.  It is also recommended to remove any 3D edible decorations prior to cutting the cake.
• If you would like any alcohol bottle(s) as part of the cake design, the bottle(s) need to be provided by the Client. Arrangements need to be made to get the bottles to me at least 4 days prior to pickup or delivery.

SERVING AMOUNTS & SIZES

The size of the cake tiers will be determined by the amount of servings needed. Serving size estimations are not guaranteed to be exact. KAP-Design is not responsible for a shortage of cake if the pieces are cut too large.

• Refer to "CAKE TERMINOLOGY" for reference photos. 
• STANDARD CAKE height - is approximately 3.5”-4” high (4 layers of cake, 3 layers of filling)
• TALLER CAKE height - (6 layers of cake, 5 layers of filling) (additional cost for labor/materials) 
• Cake breakdown is based on standard cake height unless a “taller” cake is requested. The "taller" cake option will be itemized in the breakdown/quote if applicable.  
• SHEET CAKES - (2 Thicker Layers of Cake - 1 Layer of Filling)
• 3D CARVED CAKES - these will likely be a combination of a standard cake/taller or sheet cake. The construction of the cake and filling layers needed will vary based on the design of the cake. 

Be aware that darker colored icings (ie. black, blue, red) use a lot of food coloring to get the darker colors. As such it would dye tongues and teeth temporarily when eaten. If this is a concern, I would suggest using fondant instead of buttercream for these colors for the cake base color. A layer of buttercream icing is placed under the fondant. The fondant is an additional layer on top of the buttercream. Anyone that does not like fondant can simply eat around it when they receive their slice of cake. 

Once a retainer is paid, KAP-Design and the client agree to the set amount agreed upon. However, any changes made by the client may affect the original pricing. KAP-Design reserves the right to increase or decrease price based on any changes made to the design, size of tiers, delivery location, etc. Changes to your order such as size, colors, flavors, and design will be accepted until 1 week prior to the event date. After the lockout date, KAP-Design cannot accept any changes. 

Sneak Peek Photos 

Decorating is a creative art process and pictures of the cake or treats during the creation process are not shared. Your custom product deserves and is meant to be seen in person, as pictures can be misconstrued. 

Finished Project Photos

KAP-Design would be happy to share photos with you after the delivery or pickup has taken place of your custom product that were created for you. An email can be sent to you within a couple of days of your event with photos that were taken for adding to the gallery/portfolio including social media. 

I typically take photos of the cake and/or treats that I created after they are setup at your event. 

If I was unable to take photos upon delivery (ie due to setup not being completed) or a pickup was done, I would greatly appreciate seeing photos of the final setup. I love seeing photos of the setup with your custom order at your special event. Photos shared will be added to the gallery/portfolio including on social media.

KAP-Design reserves the right to use all photographs of any items made by KAP-Design for promotion purposes.

For custom orders KAP-Design kindly requests that an order is "Booked" and retainer is paid a minimum of 1 week (2 weeks is preferred) prior to your event date. 

LARGER ORDERS

For larger orders KAP-Design kindly requests that an order is "Booked" and retainer is paid a minimum of 3 weeks (1 month is preferred) prior to your event date. Larger orders can consist of larger sized cakes, larger quantities of treats, and/or cakes and treats for one occasion.

All orders are taken on a first come, first serve basis and availability varies. 

Please note the notice timeframes mentioned above may be subject to change based on availability due to schedule changes or orders that become booked ahead of you.

Estimates for your custom order are provided to you for no charge. Requesting an estimate does not obligate you to purchase.  Use the inquiry form button below to request a free estimate. 

ESTIMATE

Upon submission of your inquiry, I will put together an estimate for your custom order. Please allow a couple of days for an estimate to be emailed back to you. During busy times it might take me a bit longer, but I will do my best to get back to you as soon as possible. If there will be a delay in getting you the estimate, I will do my best to give you an update in a timely manner.

If you have any changes to your Estimate, I would be happy to adjust as needed and send you an updated estimate for you to review. 

PLACING AN ORDER

• Send an initial non-refundable retainer payment. 
• Any applicable rental deposit will be included
• Pay electronically OR arrangements can be made for a cash payment
• The payment is considered received, when cleared at the bank for electronic payments  (may take a few days)

Due by the expiration date noted on the Estimate. Rush fee may be applied for any accepted short notice orders.

Upon receiving your signed "ORDER - CONTRACT" form an invoice will be sent to you for your order. 

ORDERS ARE CONSIDERED "BOOKED" UPON THE FOLLOWING:

• Receipt of initial non-refundable retainer payment

To prevent miscommunication, all communication between the person placing the order (aka: Client) and KAP-Design must be made between a single representative on each end. Contact information for the Client (name, cell phone and email) shall be provided at the time of the order if not previously done so to allow for any questions, payments and coordination of the order as needed.

KAP-Design and the Client will be the only designated persons who will make all communications between KAP-Design and the Client. Neither party shall have any obligation to consider for approval or respond to changes other than through the designated persons listed above. DO NOT place the order without confirming the details with anyone else involved in the decision making. Refer to DESIGN CHANGES for reference in the event that a design change is needed after an order is confirmed.  Such a change must be relayed to KAP-Design by the Client. 

I often can, and do,  accommodate short notice requests, but it cannot be guaranteed if you are not within the proper time frame. Failure to plan on your part, does not constitute an emergency on my part! If I am already booked up for the week, I will let you know. 

An additional fee may be applied to any accepted short notice orders. Short notice orders would require rearranging my schedule to fit in your order as well as my costs may be higher having to get certain supplies on short notice. If the Rush Fee applies, it will be noted in the breakdown/quote.

When I accept your custom order, there is a lot that goes into making sure your order gets completed on time; from ordering materials, to hand-making pieces, and even turning down other orders to ensure your order is completed to the highest standard. The retainer is paid to reserve the date for your order, is applied to the order total and supplies and is therefore NON-REFUNDABLE in the event of a cancellation.

Send an electronic retainer payment via Credit Card, Debit Card or Bank Account (via the QR Code or link provided in the "ORDER - CONTRACT"), OR arrangements can be made for a cash payment.

Initial Non-Refundable Retainer Payment varies on overall order & price:

• $100 or Less - Payment in full
• More than $100 - Retainer  Amount 50% 
• Rush Orders - Payment in full

ORDERS ARE CONSIDERED "BOOKED" UPON THE FOLLOWING:

• Signed "ORDER - CONTRACT"
• Receipt of initial non-refundable retainer payment

By sending payment for your order, you are also agreeing to the terms & conditions......XXXX?????

The final balance will be due one week before the event date. Although KAP-Design will send reminders, it is up to the client to send any payment(s). If final payment is not received by 7 days prior to the event date, KAP-Design will not be held responsible for completing the requested service, the order will be canceled, and KAP-Design will keep the non-refundable retainer amount. Please see Postponement / Cancelation Policy for more details. 

FULL PAYMENT IN ADVANCE IS REQUIRED TO COMPLETE YOUR ORDER

KAP-Design has a variety of cupcake stands, cake stands and other display options available for rent at a nominal fee. Custom display items such as cake stands and cake pop stands, cupcake stand decor etc. are also an option. Custom options made for your special occasion would be yours to keep. Refer to the pdf on the RENTAL page for available items. 

• If you would like to rent any items or have any stands or displays custom made for your special occasion, an updated or custom estimate can be provided to include these options.  
• Any items rented must be returned within three business days after the event date.  
• Rented items must be returned, cleaned & undamaged. 
• Upon inspection of the rented items if they are returned in good condition, the security deposit (minus the rental fee) will be returned to the customer.  
• KAP-Design will not be responsible for picking up stands or other rented items at any venue or location; otherwise a delivery fee will be incurred.  Arrangements can be made to meet up for the return of any rented items.

• If particular items are desired to be rented and indicated beforehand,  the security deposit will be noted in the estimate for your custom order. 
• The security deposit for any applicable rentals must be paid with the retainer payment for any orders. The security deposit for any rentals is noted in the pdf “Cupcake Stands & Extras Options”. 
• If the rented items are lost or damaged, the security deposit will be forfeited as I will use the security deposit for the replacement of the item that was rented. 

Pick up is FREE and delivery to anywhere in Cheshire, CT is FREE. 

A meeting location in Cheshire, CT. Specific details for the meeting location will be provided upon confirmation & payment of your order.

Once the custom order has left the pick-up location, client is responsible for any damages to the custom order. 

• Pickup time will be scheduled ahead of time that works best for both parties. 
• Please arrive on time to pick up your custom order. 
• Please contact KAP-Design asap if you think you will be late picking up your order. 
• If your scheduled pickup time will be altered (by 15 minutes or more later), alternative pickup arrangements may need be made at KAP-Design's convenience. No refunds or credit for failure to pick up your order in a timely manner. 
• Upon your arrival to the pickup location at your scheduled pickup time, you need to call or text me to let me know you are there. I will come to meet you within 10 minutes or less (pending time to load the car and any traffic).  

Delivery to anywhere in Cheshire, CT is FREE. 

Available to the party location,  your home or venue (in state (CT) only)

Delivery to the event location is strongly encouraged for larger cakes and/or larger orders. The delivery fee will be calculated for you once you provide the location and event time.

For deliveries outside of Cheshire, delivery fees will be based on the federal mileage rate of 65.5 cents per mile traveled (round trip) and rounded up to the nearest five dollars. City driving, longer distances and time frames during rush hour will have additional fees.  The delivery fee will be noted in the breakdown/estimate. 

• If KAP-Design will be late for the delivery you will be contacted asap with an ETA to the delivery location.
• If the setup location is not accessible upon arrival or if no one is available upon delivery the client will be notified. After a 15 minute grace period the custom order will be left at the delivery location in the safest place possible. No refunds or credit for the order if any damage occurs after the order leaves my possession. It is your responsibility to be available or make appropriate arrangements so the custom order is able to be delivered to the appropriate setup location and/or person handling the delivery. 

• Upon arrival to the delivery location, KAP-Design will setup the custom order at the appropriate location. 
• Please have the table(s) where the cake and/or treats will be displayed setup prior to the delivery time with any linens and decorations. This will ease in setup of the cake and/or treats when I arrive for the delivery. 
• There are no additional setup fees unless they are mentioned in the breakdown/estimate. 
• Please check with the venue (if applicable) on how early the room will be setup so we can coordinate for delivery and setup of your custom cake and/or treats. Ideally delivery/set-up should be done ahead of time prior to your event start time and to avoid rush hour time frames if possible.  
• If you have any pets or children, please have them stay in a separate area from the entry and event setup during the delivery. This allows me to carry and setup the cake and/or treats at the venue or your home easily, giving me the room to do so. I will not be responsible for any damage to the cake and/or treats by either pets or anyone inadvertently causing me to damage the cake and/or treats.

PICKUP

Once the cake and/or treats has left the pick-up location, Client is responsible for any damages. 

DELIVERY

After delivery and setup is complete and the condition of the cake and/or treats is satisfactory to the Client, KAP-Design is no longer responsible for any damages to the cake and/or treats, including but not limited to: collapse, melting in direct sunlight or high temperatures, bumping, scraping, mishandling by moving to a different table, etc. 

It is recommended to be mindful of the placement of the cake/treat table while deciding the layout of your event.
